Read Pera’s article

Adams and Reese Partner and ethics and professional responsibility attorney Lucian Pera authored “Can I Sell That?” in the March/April 2023 publication of ABA Law Practice Magazine.

Pera explores the ethics of selling forms, training, generative documents, and other expansions of traditional legal services. There are some risks to be aware of, and you will need to be very clear on scope and purpose, Pera said. Where to start? Read Model Rule 5.7 and then your jurisdiction’s version.

“No lawyer wants their new line of business to be subject to the lawyer malpractice standard of care, if that can be avoided,” wrote Pera.

Pera is a partner at Adams and Reese in the law firm’s Memphis office. He counsels lawyers, law firms, clients and those who do business with lawyers and law firms on ethics and professional responsibility issues. Pera served for five years on the ABA Ethics 2000 Commission, which rewrote the ABA Model Rules of Professional Conduct. Past President of the Tennessee Bar Association, Pera led the TBA committee that successfully proposed new legal ethics rules based on the ABA Model Rules.
