Adams and Reese Construction Team Co-Leader and Partner David Toney was interviewed in an Engineering News Record article “In the Right Context: Contract and Claims in the Wake of a More Digital Ecosystem.” The article, written by Vicki Speed, was published in ENR’s “Law & Risk Mitigation Today” section.

While the construction industry’s continued adoption of technology is driving productivity and efficiency, the digital environment is also creating some associated risk.

“The construction industry continues to face a double-edged sword from increasingly sophisticated cyberattacks, given the emergence of AI technologies, and an uptick in construction delay claims since the COVID-19 pandemic,” said Toney. “We expect these trends to continue throughout 2024 due to many factors still impacting both trends.”

In her article, Speed noted that Norton Rose Fulbright published its 2024 Annual Litigation Trends Survey, reporting that cybersecurity, data protection, and data privacy were major themes of concern across the construction industry. The survey further reported that 44% of respondents said they are concerned about cybersecurity litigation, higher than any other litigation category.
