Participants in the insurance industry encounter dual layers of risk — those impacting their customers and those affecting their own operations. Adams & Reese equips clients so they can properly safeguard both dimensions, offering strategic counsel across three critical pillars of insurance: coverage, defense, and regulatory compliance.

Insurance practice was a founding pillar at Adams & Reese. With that legacy and more than 70 years of experience, our insurance lawyers understand how companies operate, the policies they manage, and the sector’s cyclical nature. Amid an ever-shifting landscape of regulatory changes, natural disasters, lawsuits and litigation, and economic volatility, we evaluate and manage risk, so clients can concentrate on business objectives with confidence.

INDUSTRY CLIENTS

Adams & Reese insurance attorneys represent a wide array of participants in the insurance sector, including insurers, reinsurers, brokers, managing general agents, self-insured businesses, and other industry stakeholders.

Our clients range from entrepreneurial groups launching innovative insurance ventures to established national and international insurers with complex operational needs. We work with clients across diverse industries and markets. For startup insurers, we assist with corporate formation, certificates of authority, and regulatory requirements. For established insurers, we advise on policy issues, claims management, and compliance with legal frameworks.

INDUSTRY EXPERIENCE

Recognized by Chambers USA and additional business and legal publications, Adams & Reese’s insurance attorneys draw on extensive regulatory knowledge and practical experience within the industry. We advise on compliance with state and federal laws, broker licensing, and coverage issues; develop preventive plans to minimize future risks; and counsel on business matters including contractual disputes and human resources concerns. We also advise on risk transfer mechanisms, underwriting practices, and claims management to help clients mitigate exposure and streamline operations. We assist insurers with compliance audits, regulatory examinations, and filing requirements across multiple jurisdictions.

Our areas of focus span a broad range of coverage type.

  • Property and Casualty
  • Life and Health
  • Marine and Transportation
  • Cybersecurity and Data Privacy
  • Directors and Officers Liability
  • Employment Practices Liability
  • Professional Liability

In the event of litigation, our attorneys advocate for insurers and, when applicable, insureds. We work with clients at every stage, including case preparation, settlement negotiations, and appeals. Our appellate team collaborates with our insurance lawyers and litigators to represent clients in complex, high-stakes coverage disputes. When claims have been paid, we advise insurers on assessing and prosecuting subrogation actions.

Working alongside our Government Relations team, we ensure clients remain in compliance with evolving state-specific insurance regulations. We represent insurers in negotiations with regulatory bodies, and advocate for legislative initiatives aimed at capping bad-faith litigation and limiting excessive damage that inflate premiums industry-wide.

Adams & Reese lawyers have prevailed in both appellate court and in highly litigious disputes on several matters that have altered and improved the complexion of the insurance regulatory framework, often to the benefit of our clients and the insurance industry.

Following Hurricane Katrina, we represented insurers successfully against multimillion-dollar property damage claims brought forth by large policyholders. After Hurricane Ida, the Louisiana Commissioner of Insurance directed that insurers pay claims regardless of whether the terms of a prohibited use provision were met. Representing the nation’s largest property and casualty insurance provider, we challenged the directive and won.
