Even though the FBI reports cyberattacks are on the decline since 2018, organizations still face the harrowing threat of their data being stolen or even taken hostage in a ransomware attack.
In an article for law.com, "Five Harsh Truths About Ransomware Attacks," Roy Hadley addresses the high-stakes negotiations with hackers. "The last thing you want to do here is something that makes the bad actor walk away and not get back the keys if the client isn't able to recover the data on their own," says Roy.
Additionally, not all negotiations end with a successful result, which is why lawyers should be experienced in cyberattack response. "Hackers give you the keys and they don't work, or they give you keys and the files are corrupted," Roy says, noting the potential ways negotiation talks with hackers can go sour.
