Out on Disability: How to Provide Legally-Required Employee Leaves of Absence While Avoiding Leave Abuse

What's the difference between FMLA and ADA leave? What do workers' compensation laws require of employers? What are the best practices for employer policies and record keeping? Labor and employment attorney Scott Hetrick provided a comprehensive overview of legal considerations of paid and unpaid employee leave at the May 8 Greater Pensacola SHRM Legal Conference. 

In his presentation, Scott discussed the legal requirements under the Americans with Disabilities Act, the Family Medical Leave Act and state paid leave and workers’ compensation laws relating to employee absences from work.

Scott also explained to attendees how to effectively comply with the overlapping and sometimes conflicting laws relating to employee absences and combat fraudulent or abusive gaming the system by employees taking more leave than reasonably required or allowed by law.
