Greg Rouchell was interviewed in a February 11 article in New Orleans CityBusiness, "Independent Contractor Classification Becoming Major Issue in Labor Law." 

Businesses may struggle to differentiate independent contractors from employees, and, according to Greg, many businesses are misinformed about how to classify their workers. 

"Many employers mistakenly believe that all they need to do is label someone as an 'independent contractor' in a contract or agreement, and the person performing services will automatically be considered such," Greg said. "That is not the case."

There are several issues to consider, such as whether the individual can do similar work for third parties. Greg notes that it's important for businesses to shy away from making broad assertions and that no two cases are alike. The analysis to determine an employee's status is extremely intensive and can vary depending on the jurisdiction, he adds.
