Overview

Mason Pokorny practices primarily in construction law and workers' compensation compliance. He represents clients in a wide range of matters, including contract review, drafting, and negotiation, lien law, bond law, building code violations, construction defect litigation, OSHA defense, workers' compensation compliance, and contractor licensing. Mason brings a results-driven approach to his practice, combining deep industry knowledge with effective advocacy on behalf of contractors, subcontractors, and construction industry professionals.

Mason has successfully represented a prime contractor against a subcontractor in defending nonpayment claims and prosecuting construction defect claims in a seven-figure dispute involving a roof installation on a public project. He also received a favorable verdict on behalf of a contractor following a multi-day trial involving nonpayment claims and alleged construction defects on a residential project. In the regulatory arena, Mason has successfully defended numerous licensing complaints submitted to local building departments and the Florida Department of Business and Professional Regulations. He has also successfully defended and resolved numerous Amended Orders of Penalty Assessment issued by the Florida Division of Workers' Compensation.

Mason grew up in Cleveland, Ohio, where his father owned and operated a small insurance administration business and his mother worked at Tremco, Inc., a manufacturer of roofing and waterproofing systems, among other things. While in college, Mason worked for an industrial material supplier in Cleveland in the product quality control department, and thereafter assisted the National Aeronautics and Space Administration (NASA) as an independent contractor on a building renovation at the John Glenn Research Center. Mason continues to utilize his diverse employment background and experience in his representation of clients.

After graduating from law school, Mason began his career as a licensed Florida attorney at a civil defense firm where his practice focused on the representation of employers and insurance carriers in litigation of workers' compensation, employment law, and contract-related matters. Thereafter, Mason joined a civil litigation firm in Tampa, Florida where he developed his practice advocating for the construction industry in both civil litigation and administrative proceedings. This background provided Mason with a strong foundation in both transactional and litigation work, positioning him to serve the construction industry across a broad spectrum of legal needs.

  • Obtained successful trial verdict on a lien foreclosure action on behalf of a solar contractor which resulted in a judgment of the entire principal claim, as well as attorney’s fees and costs.
  • Received favorable arbitration award on behalf of an international design-builder following his successful defense of a nonpayment claim raised by a subcontractor on a public project in Melbourne, Florida.
  • Successfully defended an appeal by a customer on a claim for attorney’s fees under Florida’s Deceptive and Unfair Trade Practices Act in Money v. Home Performance Alliance, Inc., 313 So.3d 783 (2nd DCA 2021).
  • Negotiated a six-figure settlement in a lawsuit involving a Miller Act bond claim on behalf of a subcontractor on a federal project.
  • Successfully petitioned an Amended Penalty Assessment issued by the Florida Division of Workers’ Compensation against a roofing contractor that resulted in the rescission of a penalty in the amount of close to $200,000.
