Overview
Zack Rippeon is a member of the Adams & Reese Construction Practice Group and a Partner in the Atlanta office. Zack brings decades of construction industry knowledge to Adams & Reese clients, both as an attorney and as a former contractor.
An advisor, litigator, and counselor to all stakeholders in the construction and real estate industries, Zack regularly defends contractors, subcontractors and others in a wide range of disputes, including breach of contract, delays, large-scale defects, structural failures, and payment issues. He also serves as project counsel, handling contracts, change orders, supporting documentation, and compliance counseling.
Zack brings value to his clients as a former construction professional who applies technical training and hands-on jobsite experience to assist clients in business management and dispute resolution. He fully understands how job sites work and speaks the language of those he may be working with in litigation, engendering trust and helping cases move forward. Having been in control of $5M - $250M construction businesses, Zack knows well how to manage risk. Because he “used to be the person I’m deposing” regarding a construction schedule or budget issue, whether cross-examining a witness or taking a deposition, Zack knows the right questions to ask and how to ask them — getting to the heart of the matter as efficiently as possible.
Zack’s combined experience as a construction professional and as an attorney practicing in the industry enable him to provide Adams & Reese clients with a 360-degree view of proposed litigation strategy or, importantly, approaches to structuring contracts to avoid disputes whenever possible.
Zack is committed to the advancement of the construction industry through membership in multiple organizations that promote both best practices and educational opportunities. Zack is a board member of the ACE (Architecture, Construction, Engineering) Mentorship Program, which reaches out to high school students, provides hands-on CAD (Computer-Aided Design) and technology programs, and scholarships to both trade schools and four-year colleges. He is also a member of the Construction Law Section for the Atlanta Bar Association; the Associated General Contractors, Georgia Chapter; the Construction Education Foundation of Georgia; and the Associated General Contractors of America.

- Represent a cold storage design-build contractor on multiple projects throughout the southeast pursuing claims against subcontractors and defending claims from owners.
- Represent a general contractor in licensing and state regulatory requirements for projects throughout the U.S.
- Representing a sitework contractor on a federal remediation project in California pursuing unpaid emergency work for state conservation agency utilizing federal funding.
Government Facility Projects:
- Representing EPC design/build contractor against O&M prime contractor on federal ammunition processing facility in pursuing and defending delay claim and claims related to performance requirements.
- Representing 8(a) contractor against federal government in recovering delay and inefficiency claims on Air Force base in South Carolina.
- Represented a contractor in successfully resolving claims against federal government for design deficiencies in life-safety systems on Army bases in Georgia and California.
- Represented a contractor in successfully defending against subcontractor claims for delay and inefficiencies and wrongful termination on government sustainability center.
- Represented a contractor in successfully resolving defective design claims against federal government arising from unsuitable soils at Army Reserve Center.
- Represented a contractor in a full recovery against sitework and utility subcontractor arising from subcontractor default and termination at Army Depot in Texas.
- Successfully completed construction of a state college science and nursing facility, including development and management of CPM schedule and all owner/subcontractor matters.
- Successfully completed construction of multiple federal law enforcement training centers and firing ranges.
- Successfully completed construction of multiple K-12 facilities ranging from $2M to $60M, including development and management of CPM schedule and all owner/subcontractor matters.
Manufacturing Industry Projects:
- Represented a brewery regarding design and construction of processing systems for plant expansion in Georgia.
- Successfully completed construction of a dairy processing plant in South Carolina.
- Successfully completed construction of a pharmaceutical manufacturing plant upgrades in South Carolina.
Federal Hospital Projects:
- Represented a contractor in successfully defending against $20+ million Miller Act lawsuit relating to delay, inefficiency, and change order claims on a hospital facility for the federal government. Summary judgment was entered in favor of contractor as to subcontractor’s claims.
- Represented a contractor in recovery of scope and delay claims exceeding $200 million on a hospital replacement.
- Represented a facility for the federal government before the Board of Contract Appeals and Dispute Review Board.
- Represented a contractor in successfully resolving multiple claims for delay and scope on a federal psychiatric facility in California.
- Represented a contractor in successfully resolving multiple subcontractor claims for wrongful termination, Miller Act, and additional scope and delay.
Highway & Infrastructure Projects:
- Representing a Spanish infrastructure contractor in construction of a highway interchange project in Georgia.
General Contractor Projects:
- Successfully completed an extensive renovation and restoration of a church and chapel at HBCU in Georgia, including development and management of CPM schedule and all owner/subcontractor matters.
- Successfully completed the development and construction of an integrated parking facility and twin office towers in DC
- Successfully completed hospital replacement and new central utility plant in Fort Hood, Texas Red River Army Depot, Texarkana, Texas
- Successfully completed a VA Medical Center, 80-Bed Psychiatric Facility, Palo Alto, California
