Overview
With over three decades of exclusive practice in patent, trademark, and copyright law, Scott Sudderth has built a distinguished career as a trusted advisor to clients seeking to protect and maximize the value of their intellectual property assets. Scott guides national and international clients through the complexities of intellectual property prosecution and litigation, with a particular focus on technically sophisticated matters.
Scott has prepared and prosecuted nearly 2,000 U.S. and international patents throughout his career, and has a portfolio of over 600 active patents managed worldwide.
Scott’s practice centers on the preparation and prosecution of patents in complex mechanical and electro-mechanical technologies, as well as the creations and execution of overall IP development and protection strategies. Scott has represented clients in a wide range of industries, including advanced manufacturing, software, construction, textiles, machine controls, and security systems. His experience extends to managing large domestic and international IP portfolios, conducting IP due diligence for investments and acquisitions, and counseling clients on strategic IP planning and licensing.
A seasoned litigator, Scott has significant experience representing clients in federal courts and before the U.S. Patent and Trademark Office (USPTO), including in Inter Partes Reviews, Post Grant Reviews, and reexaminations. He has also managed and coordinated IP litigation matters internationally, including successful defense and enforcement actions in the United Kingdom, China, and Europe.
Scott is known for his client-focused approach, working closely with companies to develop tailored IP strategies and procedures to help clients capture, protect, and monetize their innovations. He also works closely with clients for strategic IP portfolio management, including ways to monitor and manage their IP assets in real time.
A frequent speaker and educator, Scott regularly provides on-site training and seminars to clients on intellectual property protection and best practices. His commitment to client service and technical excellence has earned him recognition in IAM Patent 1000 and Best Lawyers in America®, including being named Lawyer of the Year in Georgia for Patent Litigation.

Experience
- Preparing and prosecuting more than 1,500 patents in the United States and in a number of foreign jurisdictions, covering a diverse range of technologies, including complex mechanical & electro-mechanical systems and machinery, such as firearms, packaging equipment, textile sewing and finishing equipment, aircraft components and tracking systems, carpet tufting machines, software security, “skill” game systems, protective fabrics, bowling and entertainment center equipment and systems, and silt/sediment control materials, and dispensing systems.
- Assisting clients with policies and procedures for the development, growth and management of their IP asset portfolios.
- Reviewing patent portfolios as part of IP due diligence reviews for client investments and acquisitions.
- Prosecuting and defending patents in USPTO administrative proceedings, including Inter Partes Reviews, reexamination proceedings, trademark opposition and cancellation proceedings, and in European Patent Office proceedings.
- Acting as co-counsel in 30+ patent, trademark, trade secret, and copyright litigation matters in U.S. District Courts and USPTO Proceedings, including Inter Partes Reviews and patent appeals.
- Managing client litigation matters in China and Japan, and European Patent Office oppositions, including working with counsel in China to successfully obtain a judgement from the Supreme Court of China in a patent infringement action. This resulted in an injunction, an award of damages, and seizure of property against a Chinese company.
