Overview
Government contracting and procurement processes are among the most significant sources of public-private engagement, with local, state, and federal agencies. For both seasoned government contractors and those looking to move into the procurement space, knowing the who, what, and how is critical to successful bids and projects.
Our team of seasoned procurement and government contracting attorneys and government relations advisors assist clients with identifying the right people to engage when navigating procurement processes. Bid Response Process
Adams & Reese assists clients on both sides of the procurement process: government agencies issuing a request for proposals, and clients submitting a response to an RFP. We assist clients submitting bids by translating an RFP document: breaking down the necessary requirements, identifying areas for further clarification during a Q&A period, and identifying and minimizing risk on the front end. On the government agency side, we work with owners on development of bid requirements and management of technology and enterprise contract solutions.
Contract Administration
We also work with local governments, agencies, and other quasi-governmental organizations on the bid process, including issuances of notices to proceed, administering the contract, and coordination with vendors and subcontractors. We have experience assisting owners with utilizing alternative procurement methods such as CMAR (construction management at risk). We guide clients during performance of a contract, including the relevant contracting rules and regulations, such as contract modifications, teaming agreements, novation requirements, and mandatory disclosures.
Bid Protests and Award Defense
Once a bid process has been completed and a contract awarded, that doesn’t mean the process is over and the project begins. At times, a bidder may have reason to believe that the award was incorrect, the scoring skewed, or that questions arose on the process itself. Bidders who did not win the contract often have rights to protest the award, and this protest process can often entail administrative proceedings and potentially litigation in challenge of or (in the case of a winning bidder) in defense of the award or the process. Our team is skilled at assisting clients on both sides of the protest – either protesting a contract award or defending an award. Our team includes practitioners with extensive experience in the administrative procedures associated with procurement as well as litigation for matters that make it to court.

Experience
- Successfully overturned $200 million contract award for the State’s Medicaid enrollment contractor.
- Successfully defended $220 million contract award to Medicaid call-center contractor at all levels of administrative appeal.
- Successfully defended $180 Million contract to health care company to provide health care services to County’s inmate population.
- Successfully protested award of Federal grant money for HIV health care program because the procurement violated Federal law.
- Representing a global healthcare services and products company against False Claims Act allegations that the company improperly partnered with service-disabled veteran-owned small businesses to obtain government contracts.
- Successfully defended an economic development district in its award of a sanitation contract in Civil District Court (Orleans Parish).
- Represented a client in a bid protest on a multi-million-dollar contract for the Smart Meter program in New Orleans.
- Regularly assist charter schools with development of bid requirements and navigation through the procurement process.
- Represented an incumbent Medicaid fiscal intermediary provider who was not invited to present a proposal for the renewal of a contract worth up to $500 million over ten years. Our team deployed a two-pronged strategy, challenging the award through administrative procedure and courts while also employing a government relations strategy. Ultimately, the attempt to proceed with another vendor was cast aside and our client signed a substantial contract extension.
